A new jury has been selected for the retrial of five former junior hockey players accused of sexual assault.
Michael McLeod, Carter Hart, Alex Formenton, Dillon Dube, and Cal Foote are facing charges related to an alleged incident at a London, Ontario hotel in June 2018. All five have pleaded not guilty.
The newly selected jury consists of 14 members — nine women and five men — and replaces the original panel of 11 women and three men. A mistrial was declared Friday morning, resulting in the dismissal of the previous jury. Due to a publication ban, the specific reasons for the mistrial cannot be reported.
Justice Maria Carroccia announced the mistrial, telling the original jurors, “I’m sorry to have to tell you I’ve declared a mistrial in this case. As a result of that, this jury is going to be discharged, you are free to go.” She did not provide further details, only mentioning that an issue requiring legal discussion had come up.
With Monday coinciding with the federal election, Justice Carroccia noted that court proceedings would have a “short day” to allow jurors time to vote. The retrial is now scheduled to officially restart Monday morning.
